The Call By Dormaahene To Advice A-G Is Unlawful, Illegal and Unconstitutional – Maurice Ampaw Fires Back

Outspoken legal practitioner, Maurice Ampaw has reacted to the recent controversial comments made by Dormaahene on the trial of the Assin North MP Joseph Gyakye Quayson , describing it as “unlawful, unconstitutional and illegal.”

Lawyer Ampaw was speaking on the Privilege Morning show on Wontumi Radio/TV hosted by Oheneba Nana Asiedu, in Kumasi on Wednesday, where he did a postmortem of the law in accordance with nolle prosequi which states clearly that the president has no business to enter nolle prosequi .

He said such an attempt will not define the Attorney-General as being independent and that, “it’ll be discriminatory in the law to have sympathy for some selected individuals.”

Lawyer Ampaw continued, “Any case that will be judged by the Dormaahene, Osagyefo Agyemang Badu II will not be pleasant to any NPP member because of your position and recent comments”
“That statement wasn’t measured, but in law, the call by Nana that the president should advice the Attorney-General is illegal, unlawful and unconstitutional which he is very much aware”

Lawyer Ampaw regretted that in this particular case, the Dormaahene was speaking as a politician and showed disrespect towards the Attorney-General, and suggested that the call by the Chief could have been formally documented and presented to the office of the A-G in a form of petition to be addressed.

“I was expecting Nana to write a petition to the Attorney-General’s office in his capacity as the Dormaahene or as an ordinary Ghanaian or as a concern citizen and the A-G will hold that letter in confidence” said lawyer Ampaw.

“The Dormaahene’s statement has influenced many Ghanaians to speak without any legal respect,” he added.
