NOBODY INCLUDING DORMAAHENE CAN ADVICE, ENCOURAGE OR APPEAL TO A-G TO DROP CRIMINAL CHARGES AGAINST ASSIN NORTH MP – LAW LECTURER, GIMPA

Law lecturer at the Ghana Institute of Management and Public Administration (GIMPA), Dr Kwaku Anane Gyinde has stated emphatically, that the law in Ghana is bigger than any other person to overturn it rules not even the Dormaahene, Osagyefo Oseadeeyo Agyemang Badu II.

Reacting to the Dormaahene’s appeal to the Attorney-General (A-G), Mr Godfred Yeboah Dame, to drop the criminal charges against the Member of Parliament-elect for Assin North, James Gyakye Quayson, the lecturer said public opinion is not an important factor that determines how the Attorney-General should prosecute cases

Speaking on Wontumi Privilege morning show on Tueday hosted by Oheneba Nana Aseidu, Dr Anane noted how dangerous such an attempt could cause the nation, adding that, a new A-G can take another look at it and make a conclusion that the case still has some merit and can be proceeded to court again without any explanation.

“The Attorney-General only looks at the size of the case, evidence and compare it to the law. Public opinions are not important factors that determine A-G should prosecute or not.” He stressed.

“The law also says, it’s only the Attorney-General who can make such determination either to file for nolle prosequi or not, therefore nobody including the Dormaahene can advice, encourage or appeal to the Attorney-General to file nolle prosequi because the A-G is a professional lawyer.

He said, comments made by public cannot affect the proceedings nor judgement of the charges against the Assin North MP. The court is only interested in the charges against him which include, forgery and perjury in relation to certain alleged offences in the run up to the 2020 Assin North parliamentary election.

“If you compare the charges, the MP has offended the laws of the country, let the law speak as proceedings are ongoing. Comments from the Dormaahene is therefore unnecessary and unwarranted and we don’t expect these comments from a Judge who has sworn to the laws of the land.” he lamented.
