Court Dismisses Injunction Application By Ahinsan Chief, Others.

A Kumasi High Court, Land Division section, Thursday, 4th March, 2021 has refused an injunction application filed by the Chief of AhInsan, Nana Dwumahene Ankoana III and others to stop the Assemblyman for the Ahinsan Estate Area for using government land to construct a Police Post.

The Chief and others who were plaintiffs in the case had sought to argue that the government land in Ahinsan Estate still belonged to them.

This is despite the compensation they had earlier received on the same from the Government of Ghana about almost a decade ago.

The land, which is currently in the hands of the Asokwa Municipal Assembly, (ASKMA) houses an ultra modern Police Post built and furnished by the respected assembly man, Nana Yaw Wiredu.

The Police Post houses officers of the force and aids in their conduct of snap-checks and patrols in the residential community where petty thievery and robberies had been rampant.

DETAILS:

In dismissing the case which was presided over by Mr Samauel Obeng-Diawuo, a high court judge, a cost of GHC8, 000.00 was also awarded to the defendants represented by Nana Yaw Wiredu.

The court held that the injunction application was baseless and lacked merit.

Earlier, the Defendants legal representation in closing his case had argued for the cost of GHC 20, 000 to be placed on the plaintiffs.

However, the plaintiff pleaded that they be allowed to pay GHC 500.00.

ASSEMBLY MAN:

Speaking to this reporter after the verdict, Nana Yaw Wiredu, the first respondent and assemblyman for Ahinsan Estate expressed happiness with the verdict of the court.

He noted that the injunction application was ill conceived since what the plaintiff was seeking to do was without merit and basis

Nana Yaw however thanked the court for being forthright on the matter and accordingly dismissing the same.
