A recent High Court decision in Koforidua has resolved a long-standing land dispute in Berekuso, Eastern Region, Ghana. The court ruled in favor of the Aduana Abrade family of Asabi, declaring them the rightful owners of a large tract of land in the area.
The disputed land, situated at Asabi-Berekuso, spans approximately 409.17 acres and is bounded by lands owned by Mankralo, Onyaakesease, Dedeikrom, and the NII Ngleshie Addy Stool.
The court’s decision also perpetually enjoined Comet Properties Limited, the defendant, from dealing with any land beyond the limits specified in Exhibits “7” and “C”. These exhibits refer to a lease agreement dated May 15, 2002, and an assignment registered in 2012, which outline the terms of Comet Properties Limited’s leasehold interest in the land.
The public has been advised to take note of the court’s decision and to exercise due diligence when dealing with Comet Properties Limited or any other parties involved in the dispute.

PUBLIC NOTICE
RE: ASABI & ONYAKESEASE LANDS SITUATE AT BEREKUSO
The General Public is hereby put on notice of the decision of the High Court, Koforidua in a suit no. C1/98/2022 between Nana Osae Sakyi II, Abusuapanyin Kwame Darte vs. Comet Properties Limited.
The High Court held among others that the Aduana Abrade family of Asabi are the owners of the large tract of land situate at Asabi-Berekuso in the Eastern Region of the Republic of Ghana, described as follows.
All that piece and parcel of land situate lying and being at Berekuso in the Akwapim District in the Eastern Region of the Republic of Ghana bounded on the North by Mankralo’s land measuring on that a total distance of 1853.39 more or less on the East by property of the Aduana Abrade family of Onyaakesease measuring on that a total distance of 6839.46 feet more or less on the west by the property of Dedeikrom and measuring on that side a total distance of 5052.09 feet more or less and on the South by lands of the NII Ngleshie Addy Stool measuring on that side a total distance of 4607.61 and containing an approximate area of 409.17 acres.
The High Court further held that the Defendant is the beneficial owner by way of a leasehold interest which were in evidence as Exhibit “7 & Exhibits “C” and must restrict themselves to the said Exhibits “7” and “C”. The Defendant, its assigns and privies are perpetually injuncted from dealing with land in excess of Exhibits “7” and “C”. The general public is hereby put on notice of the judgment of the High Court, Koforidua and that anyone dealing with the Defendant must do their DUE DILIGENCE and ensure that they are within the limits as held by the Court.
Exhibit “C” is a lease dated 15th May 2002 Between Nana Acquah III, Kyidomhene of Berekuso and Nana Oteng Korankye II, Chief Berekuso of the one part and Comet Properties Limited of the other part. The lease is registered at the deeds registry of the lands commission, Koforidua as RE1205/2002 and described as follows;
ALL THAT PIECE OR PARCEL OF LAND situate lying and being at Berekuso in the Akuapim South District in the Eastern Region of the Republic of Ghana and containing an approximate Area of 200.00 Acre or 80.94 Hectare more or less and bounded on the North by Aduana Abrade family of Asabi & Onyaikesease (Lessor) land on the East by Aduana Abrade family of Asabi & Onyaikesease (Lessor) Land on the South by Nii Ngleshie Addey’s Stool Land on the West by Dedekrumo’s Land.
Exhibit “7” is an assignment between Sam Acquaah Yeboah, Eugene Harrison Asante, Michael Addo and Clifford Addo on the one part and Comet Properties limited of the other part. The said assignment is registered in the deeds registry of the Lands Commission, Koforidua as RE 2209/2012 and described as follows:
All that piece and parcel of land situate and lying at Berekuso in the Eastern Region of the Republic of Ghana and also known as Hill City bounded on the North by the Assignee’s land and measuring 1,954 feet more or less along the Northern boundary; and bounded on the South by the Odai Ntow family land and measuring 2,300 feet more or less along the Southern boundary; and bounded on the East by existing Road and measuring 1,350 feet more or less along the Eastern boundary; and bounded on the West by the Assignee’s land and measuring 920 feet more or less along the Western boundary containing an approximate area of 30 acres more or less.
