A private legal practitioner, Ralph Kwame Agyapong, has explained that Mr Agyenim Boateng Agyei the former Chief Executive Officer (CEO) for Public Procurement Authority (PPA), will either be granted or denied bail in court.
He made the above statement to the host of Movement In The Morning Political Show, Kwaku Dawuro.
The office of the Special Prosecutor has charged the former CEO for PPA, Agyenim Boateng Agyei with corruption.
He was charged with eight counts of using public office for profit and nine count of directly and indirectly influencing the procurement process to obtain a one-sided advantage in the award of a procurement contract.
His brother in law, Kwaku Arhin was also charged with one count of using public office for making profit. They are set to appear before the High Court (Criminal Division) , in Accra on Wednesday, 25th May, 2022.
In analyzing the issue, Lawyer Agyapong commented that “It is alleged that Agyenim Boateng used his office for the benefit of others as the Procurement officer. On 25th May, when they go to the court, they will read his charges and the Special Prosecutor will present his evidence and it should be beyond reasonable doubt to convict the accused person. The charges will be read one after the other and he will be asked to take his plea. After the charge and he is found guilty, his lawyer can apply for a bail which can be granted or denied”.
‘’ A Bail is a discretion of a judge based on the charge. You cannot suppress an accuse person so the prosecutor must present all his evidence to show that he should be convicted’’, he added.
In 2019 Adjenim Boateng Adjei was caught in the “Contracts for Sale” investigative documentary that was produced by the undercover journalist, Manasseh Azure Awuni.
It was revealed that Mr. Adjei formed a company called Talent Discovery Limited (TDL), with his brother-in-law holding 60% of shares while his brother-in-law, Francis Kwaku Arhin, held the remaining 40% of the shares. They were both found guilty after an investigation by The Commission of Human and Right and Administrative Justice (CHRAJ), they were both found guilty. He was banned from holding public office for 10 years.
On Wednesday, May 18, 2022, it was reported that Adjenim Boateng Adjei, has withdrawn all the money in his bank accounts that were frozen when investigations into his activities began.
