The Member of Parliament for the Manhyia South Constituency, Lawyer Nana Agyei Baffour Awuah, has expressed concerns over the Special Prosecutor’s decision to declare former Finance Minister, Hon. Kenneth Ofori-Atta, wanted.
In an interview on Wontumi’s morning show, Lawyer Awuah advised the Special Prosecutor to follow due process, as he has been taught. He suggested that the Special Prosecutor should have obtained a court order for arrest if he believed Hon. Ofori-Atta was evading investigation.
Lawyer Awuah further stated that the Special Prosecutor lacked the authority to unilaterally declare Hon. Ofori-Atta wanted, emphasizing that such decisions require judicial approval. He noted that Hon. Ofori-Atta had written to the Special Prosecutor, explaining his absence due to ill health and requesting his lawyer to represent him during investigations.
Lawyer Awuah reiterated that the Special Prosecutor has the authority to investigate and arrest individuals but must do so within the bounds of the law and with requisite court permission.
